Welcome to Kenerate AI. These Terms of Service (“Terms”) govern your access to and use of our platform, AI generation models (including images, videos, 3D assets, audio, and text), and subscription services.
By registering an account, purchasing credits, or generating content on Kenerate AI, you explicitly acknowledge that you have read, understood, and agreed to be bound by all the terms, user responsibilities, copyright ownership rules, and refund conditions set forth below.
You retain full commercial and personal copyright ownership over every single image, video, 3D model, and sound asset you generate.
You assume sole legal responsibility for all inputs, prompts, and generated outputs. Kenerate AI is strictly a tool provider.
Refund requests must be emailed within 24 hours. Subscription renewals can be canceled anytime for next month.
01.User Generated Content, User Responsibility & Limitation of Liability
Kenerate AI provides artificial intelligence tools that enable users to generate images, videos, audio, 3D assets, text, and other creative content based on user-provided prompts and instructions.
Sole Responsibility of the User
All prompts, inputs, instructions, generated content, exports, publications, distributions, sales, and any other use of content created through Kenerate AI are the sole responsibility of the user. Users are fully responsible for ensuring that their content and its use comply with all applicable laws, regulations, platform policies, and third-party rights, including copyright, trademark, privacy, publicity, and other intellectual property rights.
Kenerate AI does not pre-approve, guarantee, verify, or endorse every piece of user-generated content created through the platform. To the maximum extent permitted by applicable law, Kenerate AI, its founders, employees, affiliates, licensors, cloud providers, and partners shall not be responsible or liable for any claims, disputes, damages, losses, penalties, fines, investigations, or legal consequences arising from:
- the prompts or instructions submitted by a user;
- the content generated by the AI models;
- the publication, sharing, sale, licensing, or distribution of generated content;
- alleged copyright, trademark, privacy, publicity, defamation, or other third-party rights violations;
- misleading, inaccurate, offensive, explicit, or otherwise objectionable content;
- fraud, impersonation, harassment, spam, malware, or any unlawful activity conducted by a user; or
- any direct, indirect, incidental, consequential, special, exemplary, or punitive damages related to user-generated content or its use.
Consequences After Generation
Any consequences that occur after content is generated, including publication on social media, advertising, commercial use, resale, licensing, public distribution, legal disputes, takedown notices, account suspensions on third-party platforms, financial losses, reputational harm, or regulatory actions, are the sole responsibility of the user. Kenerate AI does not assume responsibility for how users choose to use, distribute, monetize, or present generated content.
02.Prohibited Content & Acceptable Use Policy
To maintain a secure, legally compliant ecosystem across all our payment processors and computing networks, strict usage rules apply. Users may not use Kenerate AI to create, upload, request, distribute, or promote:
- Child Sexual Abuse Material (CSAM) or any exploitation, sexualization, or endangerment of minors (Immediate Permanent ID Block);
- Non-consensual intimate imagery or explicit deepfakes involving real recognizable persons;
- Terrorism, violent extremism, or incitement of severe violence and physical harm;
- Fraud, phishing, identity theft, scams, forged civic documents, or deceptive impersonation;
- Malware, spyware, ransomware, or other disruptive malicious software scripts;
- Unlawful hate speech, targeted harassment, or credible threats of violence against protected groups; or
- Any content that violates applicable law or willfully infringes upon the statutory rights of others.
Kenerate AI reserves the right to remove content, suspend access, terminate accounts, refuse service, and cooperate with lawful requests from regulatory authorities or law enforcement where required by law.
03.Copyright Ownership & Intellectual Property
Your Creativity, Your Copyright: Whatever content you generate using Kenerate AI—whether it is AI images, cinematic videos, 3D models, voice recordings, or background music—the complete copyright and ownership belongs 100% to you. Kenerate AI claims zero intellectual property rights or royalty claims over your generated outputs. You are free to use your creations for monetization, commercial advertising, publishing, gaming projects, or any personal endeavor without restriction.
While you hold full rights to your generated assets, the underlying Kenerate AI software, models, website UI, trademarks, and algorithms remain the proprietary intellectual property of Kenerate AI and its licensors.
04.Refund Policy & Subscription Management
We strive to maintain complete financial transparency regarding credit pack purchases and recurring monthly subscription plans. Please read our refund and billing rules carefully:
- To request a refund for an unused or accidental credit pack purchase, you must send an email to support@kenerateai.com strictly within 24 hours of purchase.
- After 24 hours: If you do not contact us within the 24-hour window, no refunds will be issued under any circumstances.
- Refund approvals depend on credit usage; significantly used credit packs are ineligible for refund.
- Non-Refundable Subscription Fees: Once a monthly subscription payment is successfully cut and deducted, that payment is non-refundable for the active billing month.
- Cancel Next Month Renewal Anytime: You can stop future automatic billing at any time! To prevent renewal for the next month, simply email us at support@kenerateai.com before your billing date, or manage your renewal directly in your account settings.
05.Indemnification & Limitation of Liability
Indemnification
You agree to indemnify, defend, and hold harmless Kenerate AI and its affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, settlements, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your prompts, generated content, use of the platform, violation of these Terms, or infringement of any third-party rights.
Limitation of Liability Cap
To the maximum extent permitted by applicable law, Kenerate AI’s total aggregate liability arising out of or relating to the service shall not exceed the amount paid by the user to Kenerate AI during the twelve (12) months preceding the event giving rise to the claim.
06.Acknowledgement & Governing Law
By using Kenerate AI, you acknowledge and agree that you are solely responsible for all content you generate and for any consequences resulting from its creation, publication, distribution, commercialization, or other use, and that Kenerate AI’s responsibility is limited to providing the AI generation platform and related services in accordance with applicable law.
These Terms shall be governed by applicable laws without regard to conflict of law principles. We reserve the right to revise these terms periodically to reflect regulatory updates or expanding capabilities.
